By using or accessing the Website you accept the terms and conditions below, as revised from time to time (the "User Agreement"). You remain bound by them for as long as you use the Website. We may change this User Agreement from time to time without notice, so please review it regularly.

Ownership of rights

Any use of this Website or its content — including copying or storing it in whole or in part — other than for your own personal, non-commercial use is prohibited without Herboroot's explicit permission. All information displayed, transmitted or carried on the Website is protected by copyright and other intellectual property laws; some content may be owned by third parties. This Website is designed, updated and maintained by Herboroot or its licensors. You may not modify, publish, transmit, transfer, sell, reproduce, create derivative works from, distribute, repost, perform, display or in any way commercially exploit any content on the Website.

General terms of use

By using the Website, you agree to be bound by these Terms of Use.
You may use the Website only for lawful purposes and as permitted by Herboroot's policies. Any violation may lead to legal action under these policies and applicable law.
We do not run promotions that prompt you to make a purchase, download or other commitment without first giving you all relevant information and obtaining your explicit consent, and we do not present our products or services in a way that is inaccurate, unrealistic or untruthful.
Herboroot may require additional verification or information, and will contact you if any part of your verification is cancelled or more information is needed.
Herboroot may change, modify, add or remove any part of this document at any time, at its sole discretion and without prior written notice.
Limitation of liability: under no circumstances shall Herboroot's liability exceed the amount you paid for the product concerned.
These terms are governed by the laws of India, and any dispute is subject to the exclusive jurisdiction of the competent courts in Punjab, India.

Usage restrictions

You shall not use the Website to:

disseminate any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material;
transmit material that encourages conduct that is a criminal offence, results in civil liability or otherwise breaches any law, regulation or code of practice;
gain unauthorised access to other computer systems or networks;
interfere with any other person's use or enjoyment of the Website;
breach any applicable law;
interfere with or disrupt networks or websites connected to the Website;
make, transmit or store electronic copies of copyrighted material without the owner's permission.

You may not host, display, upload, modify, publish, transmit, update or share any information on the Website that:

belongs to another person and to which you have no right;
is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, racially or ethnically objectionable, disparaging, relates to or encourages money laundering or gambling, or is otherwise unlawful;
harms minors in any way;
infringes any patent, trademark, copyright or other proprietary right;
violates any law for the time being in force;

You are also prohibited from

violating or attempting to violate the integrity or security of the Website or its content;
transmitting any information (including messages and hyperlinks) on or through the Website that is disruptive or competitive to the services we provide;
intentionally submitting incomplete, false or inaccurate information on the Website;
making unsolicited communications to other users of the Website;
using any engine, software, tool, agent or other device or mechanism (such as spiders, robots, avatars or intelligent agents) to navigate or search the Website.

Indemnity

We disclaim all warranties or conditions, whether express or implied, including implied warranties or conditions regarding information and content. We shall not be liable to any person for any loss or damage that may arise from the use of any information contained in any of the materials on this Website. This User Agreement and any contractual obligation between you and us are governed by the laws of India. Each party to an arbitration shall bear its own costs.

You agree to defend, indemnify and hold harmless Herboroot, its employees, directors, officers, agents and their successors and assigns from and against all claims, liabilities, damages, losses, costs and expenses, including legal fees, caused by or arising out of your actions or inactions that result in any loss or liability to Herboroot or any third party — including, without limitation, a breach of any warranty, representation or undertaking, the non-fulfilment of any of your obligations under this User Agreement, or your violation of any applicable law or regulation (including intellectual property rights, payment of statutory dues and taxes, libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights). This clause survives the expiry or termination of this User Agreement.

Eligibility to use

The Website is available only to persons who can form legally binding contracts under applicable law. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872, including undischarged insolvents, are not eligible to use the Website. We may terminate your account and refuse access to the Website at our sole discretion, and the Website is not available to persons whose account has been suspended or terminated for any reason. If you access the Website from outside India, or from any Indian state that restricts such use, you are responsible for complying with the local laws that apply to you. Except where product-specific terms apply, these terms supersede all previous representations, understandings or agreements and prevail over any variance with the terms of any order you submit.

Refusal of service

We reserve the right to refuse service to anyone at any time. We may, at our sole discretion, suspend or cancel the service at any time if a computer virus, bug or other technical problem corrupts the security or proper administration of the service.

Orders, pricing and policies

All prices are in Indian Rupees and include applicable taxes. Placing an order is an offer to buy; we may decline or cancel an order (for example, if a product is unavailable, a price is shown in error or a payment cannot be verified), in which case any amount paid is refunded to the original payment method. Shipping, cancellations and returns are governed by our Shipping Policy and Return & Refund Policy, and your personal information by our Privacy Policy. Our products are traditional Ayurvedic and herbal preparations and are not intended to diagnose, treat, cure or prevent any disease; please consult a qualified doctor before use if you are pregnant, nursing, taking medication or have a medical condition.

Promotional communications

We may send you information about us, the Website, our other websites, our products, sales promotions, newsletters and SMS updates, as well as anything relating to other companies in our group or our business partners. If you would prefer not to receive any of this information, click the "unsubscribe" link in any email we send you or register as a Do Not Disturb user. We will stop sending you such information within 7 working days (days that are neither a Saturday or Sunday nor a public holiday anywhere in India) of receiving your instruction. For any clarification, please contact our customer support.

Communication

When you visit the Website or send us emails, you are communicating with us electronically, and you consent to receive communications from us electronically. We will communicate with you by email, by posting notices on the Website and — if you opt in at checkout — by WhatsApp. You agree that all agreements, notices, disclosures and other communications we provide electronically satisfy any legal requirement that they be in writing. When you give us your phone number with your email address, or ask us to call you back, you consent to receive calls on that number about your registered contact details, your orders and other Website-related matters.

Website feedback, comments and user-generated content

All reviews, comments, feedback, suggestions, ideas and other submissions disclosed or submitted to us on or through this Website, or otherwise in connection with your use of it (collectively, "Comments"), shall be and remain our property. Submitting any Comments assigns to us all worldwide rights, titles and interests in all copyrights and other intellectual property in them. Limitation of liability and disclaimers

Website security

You are prohibited from violating or attempting to violate the security of the Website, including by:

accessing data not intended for you, or logging into a server or account you are not authorised to access;
attempting to probe, scan or test the vulnerability of a system or network, or to breach security or authentication measures, without proper authorisation;
attempting to interfere with service to any user, host or network, including by submitting a virus, overloading, flooding, spamming, mail-bombing or crashing;
sending unsolicited email, including promotions or advertising of products or services;

Violations of system or network security may result in civil or criminal liability. We will investigate such occurrences and may involve, and cooperate with, law enforcement authorities in prosecuting users involved in them. We have appropriate technical and security measures in place to prevent unauthorised or unlawful access to, and accidental loss, destruction or damage of, your information; how we collect, use and protect it is described in our Privacy Policy. Payments are processed by our payment partner's secure gateway, and Herboroot does not receive or store your card, UPI or net-banking credentials. To protect your privacy and security, we verify your identity before granting access to, or making changes to, your personal information. If you have an account on the Website, your email address and password are required to access it, and you are responsible for keeping your password secure and protecting against unauthorised access to your device.

Entire agreement

If any part of this User Agreement is found to be invalid or unenforceable under applicable law — including the warranty disclaimers and liability limitations above — that provision will be replaced by a valid, enforceable provision that most closely matches its intent, and the rest of the User Agreement will continue in effect. Unless otherwise specified, this User Agreement is the entire agreement between you and us regarding the Website and its services, and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written. Our failure to act on a breach by you or others does not waive our right to act on subsequent or similar breaches.
